COLONIE, NY – A 47-year-old man is under arrest for allegedly threatening a process server with a shotgun.
According to Lt. Robert Winn, police received a 911 call at 10:22 a.m. on Saturday, March 3, from the process server who said he was threatened with a shotgun and that he heard a shot fired at 75 South Kellogg Ave.
The server was attempting to serve Marc Alling a notice of foreclosure at the time of the incident.
After knocking on the door, he did not get any response from anyone inside the home but instead heard a shot fired and allegedly saw Alling pointing the shotgun at him.
Winn said the shot is believed to have been fired into a large wooded area behind the home and in the opposite direction of the process server.
There is no evidence of the shot hitting anything.
Patrol officers using a drone set up a perimeter around Alling’s home and he was taken into custody at 11:11 a.m. without incident.
He was charged with felony criminal possession of a weapon, misdemeanor criminal possession of a weapon and the misdemeanor of menacing.
A Mossberg 12-gauge shotgun was located and confiscated as evidence.
Alling was arraigned in Colonie Town Court and sent to the Albany County jail on $30,000 bail.
